Licensing of design, construction and installation works in the Republic of Kazakhstan.

This article is devoted to construction companies planning to operate in Kazakhstan and obtain a license for construction and design activities under local laws. It is noteworthy that construction, design and architectural activities must be licensed in our country.  

Relations with the design of a building permit and a license in the field of design and construction are currently regulated by:

- Law of the republic of Kazakhstan of July 16, 2001 "On architectural, urban planning and construction activities in the Republic of Kazakhstan;

- Law of the Republic of Kazakhstan dated May 16, 2014 "On permissions and notifications"

According to the Law of the Republic of Kazakhstan of July 16, 2001 № 242-II «On architectural, urban planning and construction activities in the Republic of Kazakhstan" licensees for the implementation of project activities and construction and installation works are divided into the following categories according to the level of responsibility and performed works:

Category III - operate on objects technically simple second and third levels of responsibility, as well as work at the facilities of first and second levels of responsibility within the framework of existing license agreements for subcontracting. In other words, this type of license is issued for simple works. In order to obtain a license, applicant must have a manufacturing base or premise in the Republic of Kazakhstan to perform works under the license.

Category II - operate on objects of the second and third levels of responsibility, as well as work on the objects of the first level of responsibility within the framework of existing license agreements for subcontracting. In other words, this type of license is issued for more complicated works such as for design, construction and installation works of machine building, processing industries, agro-industrial installations and others. In order to obtain a license, it is required to have at least five years of experience in construction field and good references from previous clients in a written form. Also, applicant must have a manufacturing base or premise in the Republic of Kazakhstan to perform works under the license.

Category I - operate on objects at all levels of responsibility within the framework of the existing license. This type of license is issued for the most complicated works under dangerous facilities such as for design, construction and installation works of hazardous production buildings in the field of oil and gas, chemical and mining industries, building of railroads, pipelines, airports and others. In order to obtain a license for foreign companies, it is required to have at least ten years of experience in construction field and positive references from previous clients in a written form. This requirement is not obligatory for local Kazakh construction companies. Another requirement for applicant is to have a manufacturing base or premise in the Republic of Kazakhstan to perform works under the license.

Applicants who apply for a license for the project activities, construction and installation works, and licensees engaged in these activities should be composed of certified engineers and technical workers.

Licensing activities in the field of architecture and construction activities carried out by local executive bodies of oblasts, cities of republican significance, the capital, carrying out state architectural and construction control.

1. The license for the project activity includes:

1)      Urban design and planning

2)      Architectural design of buildings and structures, including master plans for facilities, land development, improvement and organization of relief.

3)      Construction design and construction

4)      Designing of engineering systems and networks

5)      The technological design of buildings and facilities of civil purpose

6)      Technological design of production facilities

7)      Technological design objects of transport infrastructure and communications

8)      Technological design

9)      Technological design of construction projects of agriculture, except processing enterprises.

2. The license for construction and installation work, includes:

1)      Special work in soils

2)      Structures, which includes bridges, tunnels and other artificial structures

3)      Special construction and installation work on laying the line structures, including major repairs and reconstruction

4)      The device engineering networks and systems, including major repairs and reconstruction

5)      Construction of roads and railways, including major repairs and reconstruction

6)      Installation of the process equipment, commissioning

The very important point shall be known by companies is that licenses in the Republic of Kazakhstan cannot be transferred to third parties. 

Since the delivery of the necessary documents to obtain a license in the field of construction and design, the timing of the provision of services consists of:

- For small businesses - ten working days.

- Subject to medium and large businesses - thirty working days.
