Poison licensing. Turnover of toxic substances in the Republic of Kazakhstan.

For the purpose of public safety and health activities in the Republic of Kazakhstan, the sphere of circulation of toxic substances shall be subject to licensing. For activities related to the production, processing, purchase, storage, sale, use and disposal of poisons, it must be obtained a license in the manner specified by the Law of RK "On permissions and notifications ".

Licensor or in other words, the body which have right to issue a license for production, processing, purchase, storage, sale, use and disposal of poisons is the Committee of Industrial Development and Industrial Safety of the Ministry of Investment and Development of the Republic of Kazakhstan.

From the foregoing it follows that manufacturers, suppliers, importers of poisonous substances for introduction into circulation of poisons must complete the following procedures:

1. obtain a license for the relevant activity;

2. if poisons are imported into the territory of the Republic of Kazakhstan - to get a license for import of toxic substances.

 

Obtaining a license                     

According to the Law of the Republic of Kazakhstan "On permissions and notifications" process of obtaining a license takes 15 working days. A person wishing to obtain a license shall submit to the authorized body the following documents to the licensor:

1. application form;

2. notarized copy of certificate of state registration of the legal entity or certificate on state registration of legal entity;

3. document confirming payment of the license fee;

4. The information and documents in accordance with the qualification requirements.

The list of poisons, production, processing, purchase, storage, sale, use and disposal of which is subject to licensing is approved by the Resolution of Government of RK “On approving the list of poisons, production, processing, purchase, storage, sale, use and disposal are subject to licensing”. By the legislator the list is divided into two parts: List A and B. It is noteworthy that  List A must adhere to the commitments made by the State party to the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on Their Destruction and the Law of the Republic of Kazakhstan dated June 24, 1999 № 398 "On ratification of the Convention on the Prohibition of the Development, Production, Stockpiling and Use of chemical weapons and on Their destruction. "

A legal entity or individual entrepreneur operating with following list of poisons without a license has to be brought to administrative responsibility. In case of violation of license conditions and activities related to the production, processing, purchase, storage, sale, use and disposal of poisons, the license can be stopped and cancelled by decision of court entered into force.

In conclusion, for the circulation of toxic substances on the territory of the Republic of Kazakhstan, it must be obtained a license to carry out activities on handling poisons, and in the case of import of poisons, get the appropriate import license. It should be noted that the passage of all the procedures for obtaining permits required for the circulation of toxic substances, as practice shows, is a complex process, which usually takes about 2-3 months.
